How to Serve an Eviction Notice in California

California eviction notices have strict content and service rules, and the correct method depends on the tenant and property.

6 min read

Serving a California eviction notice is a procedural step with its own requirements. The notice type, wording, cure period, and delivery method all need to match the reason for eviction and the facts of the tenancy.

Choose the right notice first

A three-day notice to pay rent or quit is not interchangeable with a notice for a curable lease violation or a termination notice. Using the wrong notice can prevent the landlord from winning possession even when rent is owed.

Include complete and accurate information

Identify the premises, the tenant, the amount or conduct at issue, the required cure, and the consequences of failing to comply. Avoid vague descriptions that leave the tenant unable to understand what must be fixed.

Follow an authorized delivery method

California permits specific service methods, including personal delivery and substitute or posting-and-mail procedures in appropriate circumstances. Document each step and use the method authorized for the situation.

Local rules may add complexity

Rent-control ordinances and local just-cause requirements can apply in addition to state law. Confirm the property's city and county rules before serving a notice.
